Revestor reserves the right to change or modify these Terms of Use or any policy or guideline of the Sites, at any time and at its sole discretion. Any changes or modification will be effective immediately upon posting of the revisions to the Site, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of the Sites following the posting of changes or modifications shall constitute your acceptance of such changes or modifications. Revestor LLC and its subsidiaries and affiliates (collectively, "Revestor") provide you with access to the Sites and the services offered by Revestor or any current and future services, products, information, patent pending algorithms, applications (downloading, installing or using the iPhone or Android Application), APIs and/or data (collectively, the "Services"). These Terms of Use govern access to and use of the Services.

No Advice

Revestor and the Services on these Sites are available only for the purpose of providing general information on homes or assets for sale by multiple-listing service, foreclosure auction, by owner or otherwise and other real estate related subject matter. Revestor is not a real estate broker/agency, real estate investment advisory service or a real estate investment advisor. We do not tell or suggest to people, what home or asset they should buy or sell. Revestor recommends that anyone buying a home as a primary residence or investing in real estate should do so with caution. While we strive to present accurate and useful information, Revestor makes no guarantee of accuracy or completeness. Do not assume that any Services, real estate indicators, ratings, insights, charts, graphs, data, or information are accurate or will ensure a profitable acquisition or investment. Therefore, you should not rely on Revestor, the Services, and the information and resources contained on the Sites as a replacement or substitute for any professional, financial, legal or other advice or counsel including but not limited to a licensed real estate agent/broker, licensed financial advisor/representative, Certified Public Accountant/Tax Professional or Attorney/Legal Advisor to determine the suitability of any purchase or investment. Revestor makes no representations and warranties, and expressly disclaims any and all liability, concerning actions taken by a user following the information or using the resources offered or provided on or through the Sites. In no way will Revestor be responsible for any actions taken or not taken based on the information or resources provided on the Sites, use at your own risk. Services

The Services include the Revestor Sites, Revestor Widgets, RevestorRent, RevestorTrend, VestorValue, RevestorRating, Vest Button, Revestor’s Integrated Services Program, Revestor’s Patent-Pending Algorithms (The ability to generate and search key real estate indicators), and other content, products and/or services available on the Sites and its affiliates. The Services may also be located on third party Web sites and/or applications either as a link from an add-on service to, or otherwise in connection with, Web sites and/or applications that such third parties control. Nothing contained in any of the Services is an offer or promise to sell a specific product for a specific price or that any advertiser will sell any product or service for any purpose or price or on any specific terms.

Third Party Websites

Revestor may run advertisements and promotions from real estate professionals or other third party advertisers on the Sites. Your business relationship, participation, communication and purchase of goods/services from such third parties, and any terms, conditions, warranties, or representations are solely between you and such third party. Revestor does not monitor or verify the truthfulness, accuracy, quality or completeness of the content, links, or activities of such third parties and is not responsible for and does not guarantee the price, terms, performance, quality, accuracy, availability or legality of any products, services, promotions or information offered by any advertiser. We are not responsible or liable, directly or indirectly for any loss or damage of any sort incurred as the result of such relationship or as a result of such third party information or advertisements on the Site. If you have a dispute with one or more advertisers or other third parties, you release and hold harmless Revestor from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Any reference on the Sites to any third party does not constitute or imply an affiliation, endorsement, adoption or recommendation. These third party sites are not under the control of Revestor. Revestor is not responsible or liable for the contents of any linked site. You should conduct the proper research before proceeding with any transaction with any of these third parties. User Content and Use

You are solely responsible for any submission, comments, messages, reviews, text, files, images, photos, videos, graphics, sounds, code, works of authorship, or other content or materials (the "User Content") that you post, submit, publish, display, or link on the Sites or send to other Revestor users. You acknowledge and agree that any and all User Content that you submit, post, link or otherwise make available on Sites is accurate, complete, and does not misrepresent you or falsely identifies you. You agree not to post, submit, publish, display, link or otherwise make available in any comment areas, forums, profile pages, or any other areas of the Sites any User Content that infringes, misappropriates or violates the rights of Revestor or any third party, including without limitation the copyright, trademark, trade secret, patent protections, publicity, privacy or other intellectual property rights of Revestor or any third party, or that is in violation of any applicable Federal, State or local law, rule or regulation, including Fair Housing Laws. You also agree not to post, submit or link any User Content that contains viruses or other malware; is disparaging, disruptive, libelous, defamatory, obscene, pornographic, indecent, harassing, threatening, abusive, inflammatory, unethical or fraudulent or that is purposely false or misleading. Revestor is to be held harmless and you shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights, or any other harm resulting from any User Content submission that you make.

You agree to pay for all royalties, fees, damages and any other monies owing any person by reason of any User Content posted by you to or through the Sites. Furthermore, you agree that by posting User Content on the Site, you are granting Revestor a royalty-free, perpetual, unrestricted, irrevocable worldwide sublicense to publish, transmit, utilize, perform, reproduce, distribute, display, modify, edit, and otherwise use this content in any manner on or in connection with the Sites or in the course of offering the Services. You understand and agree that any User Content that you post or submit to Revestor is non-proprietary and non-confidential and may be shared or distributed throughout the web and other media channels, and may be viewed by the general public. Please be sure that any information you post on any area of the Sites is information that you are comfortable sharing with others.

You further agree that Revestor does not verify, approve or control the User Content posted by others, and instead simply provides a community for users to access information that has been made available by others. As a real estate community and search engine, Revestor is not liable for any statements, representations, or User Content provided by its users on the Site or in connection with the Services. Revestor assumes no responsibility for monitoring the Site or the Services for appropriate User Content or conduct and has no obligation to screen, edit, or remove any of the User Content. However, Revestor reserves the right, in its sole discretion and without notice, to monitor, screen, edit, or remove any User Content at any time and for any reason or for no reason whatsoever. Revestor nonetheless assumes no responsibility for such User Content or for the conduct of the User submitting any such Content.

Enforcing the Terms of Use in regards to User Content is solely at Revestor’s discretion, and failure to enforce the Terms of Use in some circumstances does not constitute a waiver of our right to enforce in other circumstances. In addition, these Terms of Use do not create any private right of action on the part of any third party or any reasonable expectation that the Site will not contain any content that is prohibited by these Terms of Use.

You understand and agree that Revestor does not endorse or warrant any particular User Content on the Site or guarantee the accuracy, validity or quality of such content. Additionally, we cannot guarantee the authenticity of any content that users may provide. You acknowledge that by using the Service, you may be exposed to User Content that is unpleasant, unsuitable, or otherwise objectionable. Under no circumstances will Revestor be liable in any way for any User Content, including, but not limited to, any inaccuracies or exclusions in any User Content, or any loss or damage of any kind incurred as a result of the use of any User Content posted, submitted, published, displayed or otherwise made available via the Sites or the Service.

Intellectual Property

You will not take any action to jeopardize, limit or interfere with Revestor’s Intellectual Property Rights. You acknowledge and agree that any unauthorized use of Revestor’s Intellectual Property is a violation of this agreement and is a violation of intellectual property laws and is punishable by the fullest extent of the law. Any rights not expressly granted herein are withheld. There are no implied rights.

Mortgage

Revestor is not a licensed mortgage broker, lender or bank and does not broker loans, fund loans or make credit decisions. Revestor does not endorse or recommend the products of any Lender. Revestor assumes no responsibility for any result or consequence related directly or indirectly to any action or inaction that you take based on any mortgage professional advertising on the Sites.

Real Estate

Revestor is not a licensed real estate broker and does not broker or provide closing services for real estate transactions. Revestor does not act as a real estate agent. If you are a real estate professional, you agree that you will not claim or submit listings that do not belong to you.

Indemnification

By using the Sites and Services you agree to defend, indemnify, and hold Revestor and its subsidiaries, suppliers and affiliates, harmless from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or related to any User Content you post, store, or otherwise transmit on the Sites or your use of the Sites and the Service, including, without limitation, any actual or threatened suit, demand, or claim made against Revestor arising out of or relating to the User Content, your conduct, your violation of these Terms of Use, or your violation of the rights of any third party.

No Warranties

REVESTOR PROVIDES THE SITES AND SERVICES "AS IS," "WITH ALL FAULTS" AND "AS AVAILABLE," AND THE SOLE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REVESTOR AND ITS AFFILIATES, SUBSIDARIES AND SUPPLIERS MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. REVESTOR AND ITS AFFILIATES, SUBSIDARIES AND SUPPLIERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY AND IMPLIED, INCLUDING WITHOUT LIMITATION (I.) WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, TITLE, QUIET ENJOYMENT, NO ENCUMBRANCES, NO LIENS AND NON-INFRINGEMENT, (II.) WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING OR USAGE OF TRADE, AND (III.) WARRANTIES OR CONDITIONS OF UNINTERRUPTED ACCESS OR USE. WE DO NOT REPRESENT OR WARRANT THAT MATERIALS IN THIS SITE ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. Limitation of Liability

Choice of Law

The laws of the State of Delaware govern these Terms of Use, without giving effect to its conflict of laws provisions. You agree to submit to exclusive jurisdiction and venue in the state and federal courts in Delaware for any and all disputes, claims and actions arising from or in connection with the Services and/or these Terms of Use. In any dispute arising under this Agreement, the prevailing party will be entitled to attorneys' fees and expenses.
